RELEASE AND WAIVER OF LIABILITY & INDEMNITY AGREEMENT

Participant Acknowledgement

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE. I INTEND THIS AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID OR UNENFORCEABLE, THE REMAINDER SHALL CONTINUE IN FULL FORCE AND EFFECT.

ASSUMPTION OF RISK, RELEASE & INDEMNIFICATION

I understand that participation in pickleball clinics, camps, lessons, tournaments, open play, training sessions, and all related activities through Obsessed Pickleballers involves inherent risks including, but not limited to, falls, collisions, overexertion, equipment failure, heat-related illness, and other physical injuries which may result in serious injury, disability, or death.

I knowingly and voluntarily assume all such risks associated with participation.

In consideration of being permitted to participate, I hereby release, waive, discharge, and covenant not to sue Obsessed Pickleballers, its owners, officers, employees, coaches, independent contractors, affiliates, sponsors, host facilities, and volunteers from any and all claims, demands, losses, damages, liabilities, or causes of action of any kind, whether arising from negligence or otherwise, to the fullest extent permitted by law.

I further agree to indemnify, defend, and hold harmless all released parties from any and all claims, costs, damages, attorney’s fees, or expenses arising out of or related to my participation or the participation of the minor listed above.

MEDICAL CONSENT

I certify that I am physically fit to participate and have no medical condition that would prevent safe participation. In the event of injury or medical emergency, I authorize Obsessed Pickleballers and its staff to obtain medical treatment on my behalf. I understand that I am solely responsible for any medical costs incurred.

MEDIA RELEASE

I grant Obsessed Pickleballers the right to photograph, record, and use my image, likeness, voice, and/or video footage for promotional, marketing, and educational purposes, without compensation.

GOVERNING LAW

This agreement shall be governed by and interpreted under the laws of the State in which the event is held, United States of America.

SIGNATURE

By signing below, I acknowledge that I have read and understood this agreement and voluntarily agree to all terms.
